BuiltByTom Performance Audit (the “App”). Last updated: February 2026.
By installing, accessing or using the App (including any paid audit subscription), you agree to these terms. If you are using the App on behalf of a business, you confirm you have authority to bind that business. If you do not agree, do not use the App.
The App provides a performance audit of your Shopify store’s published theme (e.g. scripts, assets, code quality). It runs scans and shows findings and scores. Some features may be free; others may require a paid subscription or a separate quote for a full audit (as described on the App and on builtbytom.uk/audit). We do not guarantee specific results or that the App will find every possible issue.
You must: use the App only in line with Shopify’s terms and your Shopify plan; provide accurate information; not misuse or attempt to compromise the App or others’ data; and comply with applicable law. You are responsible for how you use the scan results and any changes you make to your store.
If you take a paid audit subscription (e.g. via the App or via builtbytom.uk), the price, billing interval and what’s included will be set out at the point of sign-up. Payment may be collected by Shopify Billing or by us separately. Refunds are subject to our refund policy (or Shopify’s, where applicable). We may change subscription prices or features on reasonable notice where permitted.
The App, its design, code and content (excluding your data) are owned by us or our licensors. You do not get any ownership rights in the App. You may use the App only as permitted by these terms.
To the fullest extent permitted by law, we shall not be liable for any indirect, consequential, special or punitive loss (including loss of profit, data or goodwill). Our total liability for any claim arising from or in connection with the App or these terms shall not exceed the amount you paid us in the 12 months before the claim (or £100 if no payment was made). Nothing in these terms excludes or limits our liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded or limited by law.
The App and any audit output are provided “as is”. We do not warrant that the App will be uninterrupted or error-free. Scan results are for guidance only; you are responsible for evaluating and implementing any changes to your store.
You may stop using the App at any time (e.g. by uninstalling it). We may suspend or end your access if you breach these terms or for operational or legal reasons. On termination, your right to use the App ends. We will handle your data in line with our Privacy Policy.
These terms are governed by the laws of England and Wales. The courts of England and Wales have exclusive jurisdiction (unless you are a consumer in another part of the UK, in which case you may have rights to bring proceedings in your place of residence).
If any part of these terms is held invalid, the rest remains in effect. We may update these terms; the “Last updated” date will change. Continued use after changes means you accept the new terms. Our failure to enforce a right does not waive it.
